Terms of Service

1. Purpose

These Terms of Service (TOS) govern the use of the Sakhiy platform (hereinafter referred to as "the Platform"), accessible at [URL]. The Platform facilitates free connections between donors and recipients of items, without any financial transaction.

Using the Platform implies full acceptance of these Terms of Service.

2. Definitions

• User: Any person registered on the Platform
• Donor: User offering an item as a free donation
• Recipient: User wishing to receive a free item
• Listing: Publication of an item offered for donation
• Item: Material good offered for free

3. Registration and User Account

3.1 Registration conditions

Registration is free and open to any adult. Users commit to providing accurate information and keeping it up to date.

3.2 User account

Each User is responsible for maintaining the confidentiality of their credentials and all activities performed from their account.

3.3 One account per person

Creating multiple accounts is prohibited and may result in suspension of the accounts involved.

4. Posting Listings

4.1 Mandatory free donations

Only listings for FREE donations are allowed. Any attempt to sell, exchange for payment, or barter is strictly prohibited.

The Donor is solely responsible for the content of their listing, the description and condition of the offered item.

4.4 Moderation

The Platform reserves the right to moderate, modify or delete any listing that does not comply with these TOS, without prior notice or justification.

5. Donations and Handover

5.1 Nature of relationship

The Platform is a simple intermediary. It does not participate in donation transactions and cannot be held responsible for how they proceed.

5.2 Handover arrangements

Handover arrangements (place, date, time, delivery) are agreed directly between the Donor and the Recipient. We recommend choosing public and safe locations.

5.3 Item condition

Items are given in their current condition. The Recipient is invited to inspect the item during handover.

5.4 Cancellation

In case of cancellation, parties must notify each other as soon as possible.

7. Intellectual Property

All elements of the Platform (design, logos, texts, images) are protected by intellectual property rights. Any unauthorized reproduction is prohibited.

By posting a listing, the User grants the Platform a non-exclusive license to display and distribute the published content.

8. Limitation of Liability

8.1 Platform's role

The Platform acts as a hosting service and technical intermediary. It cannot be held responsible for:

• Content posted by Users
• Quality, compliance or condition of items
• Disputes between Users
• Damage caused by donated items
• Non-delivery or cancellation of a donation

8.2 Availability

The Platform strives to ensure continuous availability but cannot guarantee uninterrupted access.

9. Personal Data

The processing of personal data is detailed in our Privacy Policy. It complies with Algerian Law 18-07 of June 10, 2018 regarding the protection of individuals in the processing of personal data.

10. Sanctions

In case of breach of these TOS, the Platform reserves the right to:

• Delete non-compliant content
• Temporarily suspend the account
• Permanently delete the account
• Initiate legal proceedings if necessary

11. Modification of Terms

The Platform reserves the right to modify these TOS at any time. Users will be informed of the changes and must accept them to continue using the Platform.

12. Applicable Law and Disputes

These TOS are governed by Algerian law, particularly Law 18-07 of June 10, 2018 on the protection of personal data and Law 09-04 of August 5, 2009 on the prevention and fight against offenses related to information and communication technologies.

In case of dispute, the parties commit to seeking an amicable solution. Otherwise, Algerian courts will have sole jurisdiction.
